These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "user") and Gold Coast Strategies LLC dba PassportSnap ("PassportSnap," "we," "us," or "our"). These Terms govern your access to and use of the PassportSnap mobile application for iOS, the PassportSnap web application at www.passportsnapapp.com, and any related services (collectively, the "Service").
By downloading, installing, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
PassportSnap is a tool that assists users in taking, formatting, and sizing photos for use in passport, visa, and other identification document applications. The Service provides guidance on photo positioning, sizing, and compliance with common photo requirements. All photo processing is performed entirely on your device — your photos are never uploaded to our servers.
You are solely responsible for ensuring that any photo you submit to a government agency or other authority meets that authority's current requirements. PassportSnap provides guidance and tools to assist you, but the final responsibility for photo compliance rests entirely with you.
Without limiting the foregoing, you acknowledge and agree that:
Many government agencies, including the U.S. Department of State, prohibit the use of photos that have been created or edited using artificial intelligence (AI) or certain digital editing tools. These restrictions may apply to AI-generated images, AI-enhanced or AI-altered photos, photos with digitally modified backgrounds, facial features, or other elements, and photos processed through AI-based beautification or correction filters.
PassportSnap does not use AI to generate or alter your photos. The Service uses on-device technology solely to assist with positioning, sizing, and compliance guidance. However, if you use any external AI tools or filters on your photo before or after using PassportSnap, you do so at your own risk.
PassportSnap assumes no responsibility or liability if a photo is rejected because it was edited using AI tools or any other digital editing software outside of the Service. It is your sole responsibility to ensure that your photo complies with all applicable government requirements regarding digital editing and AI usage.
All content, features, functionality, design, source code, HTML, CSS, JavaScript, algorithms, graphics, logos, trademarks, trade names, and other intellectual property associated with the Service (collectively, "PassportSnap Content") are and shall remain the exclusive property of Gold Coast Strategies LLC dba PassportSnap, or its licensors, and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, strictly in accordance with these Terms. You expressly agree that you will not:
Any unauthorized use of PassportSnap Content constitutes a breach of these Terms and may violate applicable copyright, trademark, and other laws. We reserve the right to pursue all available legal remedies, including injunctive relief and monetary damages, against any person or entity that violates these provisions.
PassportSnap Content is protected under the Digital Millennium Copyright Act (DMCA) and applicable international copyright treaties. If you believe that any content on the Service infringes your copyright, or if we identify unauthorized use of our intellectual property, we reserve the right to take appropriate legal action, including filing DMCA takedown notices.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

To the fullest extent permitted by applicable law, PassportSnap expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, PassportSnap does not warrant that:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PASSPORTSNAP, GOLD COAST STRATEGIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
IN NO EVENT SHALL PASSPORTSNAP'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO PASSPORTSNAP FOR USE OF THE SERVICE.
The limitations set forth in this section shall apply regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, and even if PassportSnap has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless PassportSnap, Gold Coast Strategies LLC, and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service ("Dispute") shall be resolved exclusively through final and binding arbitration, rather than in court, except as otherwise provided in this section. The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. Arbitration shall take place in the State of Texas, or at another mutually agreed location, and shall be conducted by a single arbitrator.
The arbitrator shall have exclusive authority to resolve all Disputes, including the scope, enforceability, and arbitrability of this arbitration agreement. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
YOU AND PASSPORTSNAP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration agreement shall be null and void, and the Dispute shall proceed in court.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
These Terms and any Dispute arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions. To the extent that litigation is permissible under these Terms, the exclusive jurisdiction and venue shall be the state and federal courts located in Texas.
PassportSnap reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where practicable, notify you through the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and PassportSnap regarding the Service and supersede all prior or contemporaneous agreements, understandings, or representations.
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: The failure of PassportSnap to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. PassportSnap may assign these Terms without restriction.
No Third-Party Beneficiaries: These Terms do not confer any rights or benefits on any third party.
